Course Aim:

By the end of the training course staff will have an understanding of the Mental Capacity Act 2005 including any changes or updates in the laws & legislations.

All staff within the position of assisting any Vulnerable Adult

Contents of our Course:

  • Understand how the Mental Capacity Act (MCA) 2005 and Deprivation of Liberty Safeguards (DoLS) 2007 work together
  • To be able to explain what mental capacity is
  • To know the 5 core principles of MCA
  • Be able to relate MCA to Safeguarding issues
  • To recognise and understand MCA 1&2 (the two stage process)

At the end of the training session candidates will have covered the following modules:

  • Mental Capacity Act 2005
  • Mental Health Act 2007
  • The Legal Framework
  • What is the Mental Capacity Act 2005
  • Who is Affected by the Mental Capacity Act 2005
  • The five core principles
  • What mental capacity means
  • What is lack of mental capacity
  • How mental capacity is assessed
  • Common Law tests of mental capacity
  • The ‘Acid’ test
  • Records and record keeping
  • Best Interests
  • Lasting Powers of Attorney
  • The Court of Protection and the Office of Public Guardian

Throughout this course candidates will also have the opportunity to view and discuss short films relevant to the subject matter.
